Please read this agreement carefully before accessing or using the websites operated by Symbio Denver Corp (the "Company," "we," "us," or "our"), including symbiohomes.com and symbiocash.com, or any related voice and mobile applications, online features, services, or programs related to lead generation, responding to inquiries, and real estate and related services (collectively, the "Service"). Each time you access or use the Service, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.
About our name. Symbio Denver Corp is the legal entity that operates the Service. Symbio Homes, Symbio Denver, Symbio Property Management, and Symbio Cash are trade names ("DBAs") of Symbio Denver Corp. References to "Symbio Homes," "Symbio," or the Company in these Terms refer to the same business.
Certain areas of the Service may be subject to additional terms that will be made available for your review. By using such areas, you agree to those additional terms. If any additional terms conflict with these Terms, the additional terms control for that area.
You agree to abide by all applicable local, state, national, and international laws and regulations pertaining to your access and use of the Service. You acknowledge that your use of the Internet to access the Service is solely at your own risk.
Opting out. You may opt out at any time. To stop text messages, reply STOP (or UNSUBSCRIBE, CANCEL, END, or QUIT) to any text. To stop marketing emails, click the unsubscribe link in any such email. To stop phone calls, tell us by phone, text, or email. We will make commercially reasonable efforts to honor opt-out requests promptly.
Symbio Homes Text Messaging.
By opting in, you may receive recurring text messages related to property alerts, listings, appointment reminders, real estate and market updates, customer service communications, transaction updates, and responses to your inquiries.
Your opt-in applies only to Symbio Homes and only to the program(s) for which it was given. It is not transferable or assignable to any other party, and we do not use your opt-in to send messages on behalf of unrelated companies.
Message frequency varies based on your activity and the alerts you request.
Message and data rates may apply. Contact your wireless carrier for details about your plan.
To stop receiving text messages, reply STOP to any message. You may also reply UNSUBSCRIBE, CANCEL, END, or QUIT. We honor opt-out requests regardless of capitalization, punctuation, or minor variations in wording. After you opt out, we will send a one-time confirmation message, after which you will receive no further messages from that program unless you opt back in.
If you opt out and later wish to rejoin, sign up again as you did the first time — through our opt-in page — or text START, and we will resume messages.

We aim to avoid sending marketing messages during quiet hours (generally 9:00 p.m. to 8:00 a.m. in your local time zone), except for messages you specifically request.
Carriers are not liable for delayed or undelivered messages.
The program does not send content related to sex, hate, alcohol, firearms, or tobacco ("SHAFT"), nor any unlawful or prohibited content.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties except as needed to deliver the messaging service or as required by law. See our Privacy Policy.
This program is operated in accordance with applicable carrier requirements, the CTIA Messaging Principles and Best Practices, and applicable law, including the Telephone Consumer Protection Act (TCPA).
When you create an account, you warrant that you are over the age of 18 and that the information you provide is accurate, complete, and current. Inaccurate or obsolete information may result in termination of your account. You are responsible for maintaining the confidentiality of your account and password and for all activity under your account. Notify us immediately of any unauthorized use. You may not use a username that belongs to another person or entity, that you are not authorized to use, or that is offensive or obscene. If you choose to communicate with or meet other users, you do so at your own risk and assume all associated risks.
The Service may allow you to post or share information, text, graphics, video, or other material ("Content"). You are responsible for the Content you post, including its legality, reliability, and appropriateness. You must not post Content that is libelous, defamatory, harassing, abusive, threatening, or that infringes the rights of others; that contains another person's private information without permission; that contains malware or disrupts the Service; that encourages illegal conduct or violates any law; that is bigoted, hateful, obscene, or pornographic; that could harm minors; that impersonates another person or misrepresents your affiliation; that constitutes spam or unauthorized advertising; or that infringes any copyright, trademark, or other intellectual property right.
We have the right, but not the obligation, to monitor, edit, or remove Content in our sole discretion. You retain your rights to Content you submit, but by posting it you grant the Company a right and license to use, modify, display, reproduce, and distribute such Content on and through the Service. You represent that you own or have the right to post the Content and that it does not violate the rights of any third party.
To purchase any product or service through the Service, you may be required to supply information relevant to your purchase. You represent that you have the legal right to use any payment method used and that the information you supply is true and accurate. The Service may use third-party payment processors. We reserve the right to refuse or cancel an order for reasons including suspected fraud, unavailability, or errors in description or price.
We are constantly updating the Service, and there may be delays between updates and corresponding changes elsewhere. Information on the Service may contain errors, inaccuracies, or omissions, and we do not guarantee its accuracy or completeness. We reserve the right to correct errors and update information at any time without prior notice.
The Service and its original content (excluding user Content), features, and functionality are and will remain the exclusive property of the Company and its licensors, protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.
If you believe Content on the Service infringes your copyright, you may submit a notice to our Copyright Agent at Support@symbiohomes.com (subject line "Copyright Infringement") or by mail to the address below, including: an electronic or physical signature of the person authorized to act on behalf of the copyright owner; a description of the copyrighted work claimed to be infringed; identification of the allegedly infringing material and its location; your address, telephone number, and email; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the information is accurate and that you are authorized to act. (See 17 U.S.C. § 512(c)(3).)
The Service may link to third-party websites we do not control. We are not responsible for the content, accuracy, or practices of any linked site, and we encourage you to review their terms and privacy policies.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, in our sole discretion, for any reason, including breach of these Terms. If you wish to terminate your account, email us at Support@symbiohomes.com. Provisions that by their nature should survive termination shall survive.
You agree to defend, indemnify, and hold harmless Symbio Denver Corp and its licensees, licensors, employees, contractors, agents, officers, and directors from any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorneys' fees) arising from: (a) your use of and access to the Service, or use by anyone using your account; (b) a breach of these Terms; or (c) Content you post.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY CONTENT, OR ANY PRODUCT OR SERVICE OBTAINED THROUGH THE SERVICE. UNDER NO CIRCUMSTANCES SHALL THE COMPANY'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID, IF ANY, FOR USING THE SERVICE.
THE SERVICE AND ALL CONTENT, TOOLS, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you.
The Company shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, fire, flood, earthquake, accidents, strikes, war, terrorism, governmental acts, failure of common carriers or service providers, and shortages of transportation, fuel, energy, labor, or materials.
These Terms are governed by the laws of the State of Colorado, exclusive of its choice-of-law rules. For disputes not subject to arbitration, you and the Company agree to the exclusive jurisdiction of the state or federal courts located in Colorado and waive any objection to venue and any right to a jury trial.
Any claim or proceeding between you and the Company shall be conducted on an individual basis and not in any class, mass, consolidated, or representative action. You further waive any right to a jury trial. Whether all or part of this waiver is enforceable may be determined only by a court of competent jurisdiction.
California. Under California Civil Code § 1789.3, California users may file complaints with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, by phone at (916) 445-1254 or 1-800-952-5210, or by email at dca@dca.ca.gov.
New Jersey. Any disclaimer, limitation of liability, indemnification, or damages provision herein applies to New Jersey residents and transactions only to the extent permitted by New Jersey law or public policy.
If any part of these Terms is held unlawful, void, or unenforceable, that provision shall be severable and shall not affect the validity of the remaining provisions.
These Terms, together with our Privacy Policy and any other posted agreements, constitute the entire agreement between you and the Company regarding the Service and supersede any prior agreements. Our Privacy Policy is incorporated by reference.
We may modify these Terms at any time by posting the revised version. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you object to any change, your sole recourse is to discontinue use of the Service.
